Cuando proyectamos el concepto de dignidad al ámbito médico surge inexorablemente la pregunta acerca del trato que merece el paciente y en qué consiste su dignidad. Esta reflexión se encuentra obstaculizada por el hecho de que la ciencia moderna se ha focalizado de modo casi obsesivo en reducir la vulnerabilidad humana, que ha sido vista como el mal absoluto a combatir, y a exaltar simultáneamente la autonomía de la persona. Es necesario encuadrar al paciente terminal en la categoría de persona vulnerable. En el ordenamiento jurídico argentino encontramos normas tuitivas de las personas vulnerables, en especial las que les posibilitan el acceso a la tutela judicial efectiva. En julio de 2022 se promulgó en Argentina la ley 27.678 que busca garantizar el acceso integral a las prestaciones de cuidados paliativos a todos los pacientes que padezcan enfermedades limitantes o amenazantes de la vida.
When we project the concept of dignity to the medical field, the question inexorably arises about the treatment that the patient deserves and what his dignity consists of. This reflection is hampered by the fact that modern science has focused almost obsessively on reducing human vulnerability, which has been seen as the absolute evil to combat, and simultaneously exalting the autonomy of the person. It is necessary to locate the terminal patient in the category of vulnerable person. In the Argentine legal system we find protective rules for vulnerable people, especially those that allow them access to effective judicial protection. In July 2022, Law 27,678 was enacted in Argentina, which seeks to guarantee comprehensive access to palliative care benefits for all patients suffering from life-limiting or life-threatening illnesses.
