En el presente trabajo nos proponemos reflexionar acerca de la necesidad de recuperar una concepción integral del ordenamiento jurídico normativo argentino – y en particular, de la Constitución Nacional – desde sus principios fundantes, como respuesta a la problemática suscitada por una falsa neutralidad sobre la materia. A tal fin, profundizaremos sobre cuáles son esos principios y por qué afirmamos que son constitutivos de nuestro ordenamiento, entablando, luego, un diálogo con una posición divergente – el constitucionalista Roberto Gargarella –, contraponiéndola, finalmente, con la postura de Gustavo Martínez Zuviría. De esta manera, procuraremos hacer un aporte al irrenunciable debate en orden a rescatar los principios jurídicos constitutivos, y por ello irrenunciables, como requisito esencial, aunque no suficiente, para reivindicar la concordia política en nuestra Nación.
In this work we intend to reflect on the need to recover an integral conception of the Argentine legal system —especially of the National Constitution— from its founding principles, as a response to the difficulties caused by a false neutrality on the matter. With this aim in mind, we will delve into what those principles are and why we affirm that they are constitutive of our legal system, then we will engage in a dialogue with a divergent position – the constitutionalist Roberto Gargarella –, and finally we will compare it with the position of Gustavo Martínez Zuviría. In this way, we will try to make a contribution to the unwaiverable debate in order to rescue the constitutive —and therefore inalienable— principles of law as an essential requirement, although not sufficient, to defend political harmony in our Nation.
